1. Service Description

TailTrak is a Pet Care & Monitoring Platform that helps pet owners track and manage their pets' care, activities, and overall wellness. Our services include care logging, GPS activity tracking (TrakME), weight and growth monitoring, TailTrak Insights, medication management, and professional integrations (TailTrak Pro).

2. Account Requirements

• You must be at least 18 years of age to create an account
• You may only maintain one personal account
• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when creating your account

3. Acceptable Use

TailTrak is intended for personal pet care management. You agree not to:

• Use the service for commercial purposes without a TailTrak Pro subscription
• Share your account with others outside your household or allow unauthorized access
• Upload inappropriate, harmful, or illegal content
• Attempt to access other users' data without authorization
• Use automated tools to scrape or collect data from the service

5. How We Use Your Data

This section explains how TailTrak collects, uses, and processes the information you and your pet generate on the platform. By creating an account and using TailTrak, you acknowledge and agree to these practices.

5a. Data We Collect

When you use TailTrak, we collect information you directly provide, including:

• Pet profiles: species, breed, sex, date of birth, and physical characteristics
• Care and wellness inputs: weight entries, body condition scores, activity logs, medication records, and care notes
• Photos and media you upload
• GPS and activity data generated through TrakME
• Account and usage information, including device type, browser, and how you interact with TailTrak

5b. Anonymized Data Pools for Platform Improvement

TailTrak may anonymize the inputs you contribute — removing all information that directly identifies you or your specific pet — and incorporate that anonymized data into aggregate pools used to maintain and improve the accuracy of TailTrak Insights over time.

Anonymized data contributed to these pools is retained even after account deletion, as it exists only as aggregate data with no connection to you or your pet. See Section 9 (Account Termination) for more detail.

TailTrak does not sell user data of any kind to third parties.

5c. Marketing, Personalization, and Promotional Use

By creating a TailTrak account, you agree to the following marketing and promotional uses of your data and your pet's content. You may opt out of promotional use at any time by adjusting your preferences in Account Settings under "Notifications & Privacy."

TailTrak may use information about how you interact with the platform — including features you engage with and general usage patterns — for marketing and personalization purposes, including:

• In-app promotions, feature announcements, and recommendations tailored to your usage and your pet's profile
• Targeted communications and advertising based on your in-app activity and inferred interests
• Measuring the effectiveness of marketing campaigns and improving how we communicate with you

TailTrak may also use photos you upload and non-identifying pet information — such as your pet's name, breed, and age — in promotional and marketing materials, including advertisements, social media, and other public-facing content. Your personal information and any details that could identify you as the owner will never be included in promotional materials.

If you opt out of promotional use, TailTrak will not use your pet's photos or information in any new promotional materials going forward. However, promotional materials already in public circulation at the time of your opt-out cannot be guaranteed to be fully recalled or removed, and TailTrak makes no such guarantee with respect to content already published.

We do not share your personal information or identifiable pet records with advertisers or third-party marketing partners.

5d. Data Sharing

TailTrak does not sell user data. We may share data only with:

• Service providers who assist us in operating the platform (e.g., cloud hosting, payment processing, analytics), under confidentiality obligations
• TailTrak Pro professionals you explicitly connect with through the platform
• Law enforcement or regulatory authorities when required by law

6. TailTrak Pro

TailTrak Pro is a separate professional workspace designed for veterinarians, groomers, trainers, breeders, and other pet care professionals. Professional accounts are subject to additional terms governing client data handling, professional conduct, and business use.

7. Subscriptions & Payment

• TailTrak offers a free tier and a paid MVP subscription ($9.99/month)
• MVP subscriptions auto-renew monthly unless cancelled
• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• All payments are processed securely through Stripe

8. Your Content

You retain ownership of all content you upload to TailTrak, including photos, records, and notes. By using our service, you grant TailTrak a license to process and display your content to provide the platform to you, to anonymize and incorporate your pet's data into aggregate pools for platform improvement as described in Section 5b, and to use your pet's photos and non-identifying information in promotional materials as described in Section 5c. This license survives account deletion solely to the extent that anonymized data has already been incorporated into aggregate pools, and with respect to promotional materials already in public circulation at the time of any opt-out or account deletion.

9. Account Termination

• You may delete your account at any time from Account Settings
• Upon deletion, your personal account information, pet profiles, photos, and all identifiable records will be permanently removed from our active systems
• Anonymized data already incorporated into aggregate pools is retained, as it exists only as statistical data with no connection to your or your pet's identity
• Promotional materials already in public circulation at the time of account deletion are subject to the same limitations described in Section 5c
• We reserve the right to suspend or terminate accounts that violate these terms, without obligation to provide a refund for any remaining subscription period
• We will provide notice before termination except in cases of severe or ongoing violations

10. Limitation of Liability

TailTrak is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the platform, including decisions made based on TailTrak Insights. Users who violate these Terms of Service forfeit any right to claim damages or seek compensation from TailTrak arising from or related to such violations. For all other claims, our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

11. Governing Law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts located in Texas.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of TailTrak after changes take effect constitutes acceptance of the updated terms.
